On October 17, 2018, cannabis was declared legal in New Brunswick, and residents aged 19 and above have been experiencing the benefits of legalization since then. Adults of legal age can now buy, possess, and use cannabis, as long as they respect both provincial and federal laws.

New Brunswick politicians passed their own set of provincial legislation intended at preserving public health and safety following province-wide legalization on October 17, 2018. Cannabis NB sells all cannabis in the province, which is regulated by NB Liquor.

Age Restrictions

New Brunswick has set the minimum age for cannabis purchase and use at 19.

Possession

Adults age 19 or up are permitted to possess up to 30 grams of cannabis outside. There are presently no restrictions on the amount of cannabis that is meant for home storage; however, all cannabis must be maintained in a safe area that is unavailable to anybody under the age of 19. Source

Purchasing

When buying legal cannabis in New Brunswick, there are two choices:

  • Cannabis NB retail stores
  • Cannabis NB’s online shop

CannabisNB, a subdivision of the New Brunswick Liquor Corporation, is the only place where it is legal to buy it.

Consumption

Adults of legal age are legally allowed to consume cannabis only in private residences, land close to the private residence, or unoccupied land with authorization. Consumption of cannabis in any public location is strictly prohibited at present.

Transportation

It is illegal to transport cannabis beyond Canada’s national borders. Adults must be informed of and follow the regulations of the province in which they will be going while moving cannabis within Canada.

Adults 19 years of age and older are legally permitted to transport cannabis in their vehicles, provided they fulfill the following guidelines:

  • The cannabis must be in its original packaging, which has never been opened.
  • The cannabis must be out of access to the driver and any passengers of the vehicle.
  • It is illegal to take cannabis across Canada’s international borders.
Driving While Intoxicated

Driving while under the influence of cannabis is strictly prohibited in New Brunswick.

Cultivation

Adults of legal age are permitted to grow up to four cannabis plants per home. Adults must only produce cannabis from seeds obtained from legal cannabis retailers.
